PATIENT RIGHTS: GRIEVANCE REVIEW TIME FRAMES

Based on observation, review of documentation, and staff interviews, the facility failed to followed their own policy in regard to reporting suspected abuse and neglect of patient #1.

Findings were:

Review of policy # PC 100.06 Abuse and Neglect Date Revise 3/2018, stated, "6.3.2The Texas Family Code Chapter 261 requires reporting of various types of sexual abuse. 6.3.7 A licensed Healthcare professional shall notify the appropriated authorities immediately and Care Transition Manager or Social worker of all cases of suspected abuse, neglect or exploitation.

An interview was conducted with staff #2 risk manager at the facility on 1/30/19 at 0935 in the conference room. The surveyor asked staff #2 about the allegations of sexual assault made by patient #1. Staff #2 said she did talk to patient #1 on 5/24/19. There was no documentation available of the incident/grievance and there was no reporting of the alleged incident to Adult Protective Services (APS) or police department.
