Based on interview and record review, Hospital A (Parkland Health & Hospital System) failed to enforce its policy to ensure compliance with 489.24 for 1 of 1 patient (Patient #1) in that (Patient #1) was transported to Hospital A's ER (emergency room) on 04/03/14 per EMS (emergency medical services). Upon arrival to Hospital A (Patient #1) was not provided a medical screening. (Patient #1) left Hospital A escorted by EMS and was taken to Hospital B's ER for a medical screening on 04/03/14. Hospital A had both the capacity and capability to accept (Patient #1) on 04/03/14.

MEDICAL SCREENING EXAM

Based on record review and interview, Hospital A (Parkland Health & Hospital System) failed to provide a medical screening for 1 of 1 patient (Patient #1) who was transported to Hospital A's ER (emergency room) by EMS (emergency medical services) on 04/03/14 for a medical screening. (Patient #1) left Hospital A's ER on 04/03/14 escorted by EMS personnel and was taken to Hospital B for a medical screening.

Findings Included:

The EMS record dated 04/03/14 reflected, "Upon arrival (Patient #1) was combative, history of Autism...being physically restrained by police officers...the decision while in route to Hospital B was to take patient to Hospital A...upon arrival at Hospital A at 0949, the patient was rolled in front of the admission counter...EMS received a radio transmission to transport patient to Hospital B...the patient was moved from Hospital A's main ER entrance to Hospital B's ER entrance..."

A recorded phone log for 04/03/14 from 0935 to 1025 revealed the following;

On 04/03/14 at 0935 (9 minutes, 32 seconds) "20 year old...given Versed...to Hospital A...bring to Hospital A...physician cannot make a decision bring him to Hospital A..."

On 04/03/14 at 0955 "EMS on property at Hospital A..."

On 06/18/14 at 1033 Personnel #3 was interviewed. Personnel #3 stated EMS arrived at Hospital A with (Patient #1). Personnel #3 stated no medical screening was done on (Patient #1) when he first arrived at Hospital A.

The policy and procedure entitled, "Patient transfer and Emergency Medical Treatment & Active Labor Act Compliance with a revision date of 06/12 reflected, "An MSE (medical screening examination) is required when an individual comes by him or herself, or with another individual to hospital property...a need, for examination or treatment..."
