Based on document review and interview, it was determined that for 1 of 3 (Pt. #2) clinical records reviewed for allegation of abuse, the Hospital failed to report the allegation of abuse in accordance with the IDPH (Illinois Department of Public Health) regulations, to ensure patient was free from all forms of abuse or harassment.
Findings include:
1. On 6/15/2021, the Hospital's policy titled, "Patient Abuse and Neglect" (effective 11/2014) was reviewed and included, " ... All allegations of patient abuse will be thoroughly investigated ... III. Procedure ... 18. Thorough investigations of allegations of abuse ... will be documented on "Confidential Incident Investigation" forms. The investigation will consist of timely review of ... g. Documentation of notification to appropriate state ... agencies ..."
2. Per TITLE 77: PUBLIC HEALTH CHAPTER I: DEPARTMENT OF PUBLIC HEALTH SUBCHAPTER b: HOSPITALS AND AMBULATORY CARE FACILITIES PART 250 HOSPITAL LICENSING REQUIREMENTS ... Section 250.260 Patients' Rights ... c) Patient Protection from Abuse ... 3) Any hospital administrator, agent, employee, or medical staff member who has reasonable cause to believe that any patient with whom he or she has direct contact has been subjected to abuse in the hospital shall promptly report or cause a report to be made to a designated hospital administrator responsible for providing such reports to the Department as required by this subsection (c)... 5) Upon receiving a report under subsection (c)(3), the hospital shall submit the report to the Department within 24 hours after obtaining such report..."
3. On 6/15/2021, the incident report for Pt. #2 dated 6/7/2021 was reviewed and included, " ... (Date of incident): 6/7/2021 (at 5:20 PM) ... Specific location ... hallway ... Type of Incident ... Allegation of abuse ... (Pt. #2) noted very anxious, demanding to leave the Hospital ... (vital signs) were checked and results were unremarkable. (Pt. #2) continuously demanding to leave the Hospital. Staff was trying to redirect (Pt. #2) but became hostile and verbally abusive. (Pt. #2) then escorted by a staff to his room. (Pt. #2) claims he was manhandled by the staff. Psychiatrist and medical (physician) made aware ... No injury ..."
4. On 6/15/2021, the clinical record of Pt. #2 was reviewed. Pt. #2 was admitted to the Hospital on 6/4/2021 with a diagnosis of schizoaffective disorder.
5. On 6/15/2021 between 11:30 AM and 1:00 PM, interviews were conducted with E #2 (Director of Risk). Regarding notification of the IDPH for reports of abuse, E #2 said, "State (IDPH) is normally notified within 24 hours." E #2 stated that Pt. #2's report of being manhandled by a staff was not reported to IDPH.
6. On 6/15/2021 at approximately 2:10 PM, an interview was conducted with E #1 (Director of Nursing). E #1 stated that E #2 is the person responsible for reporting allegations of abuse to IDPH.
