Based on review of the Professional Services Agreement and staff interview, the Governing Body failed to ensure a written agreement to provide emergency services to patients was current and up to date for 1 of 1 agreements reviewed.

The findings included:

Review on 01/09/2024 of the facility contract titled "SECOND AMENDED & RESTATED PROFESSIONAL SERVICES AGREEMENT" revealed an agreement between the named hospital and the named university for a full-time, physician staffed and supervised emergency services coverage to the named hospital that expired on June 30, 2023.

Interview on 01/10/2024 at 1130 with the Chief Medical Officer #1 revealed the named university and the named hospital have had an ongoing contract. Interview revealed "The agreement was to continue honoring the contract while we negotiated to figure out services and costs." Interview revealed that while the contract was late, physician services to the ED (emergency department) were still provided. Interview revealed there was no lack of care for patients and patients' insurance was not harmed. Interview revealed the lack of contract did not affect privileging or credentialing. Interview revealed in a meeting on 01/04/2024 the team discussed a plan to be done with negotiations by the end of January 2024. Interview revealed there was no current, up to date agreement between the two parties since June 30, 2023.
