The hospital failed one of one patient (Patient #11) by not allowing her representative (as allowed under State law) the right to make informed decisions regarding her care. The patient's rights include being informed of his or her health status, being involved in care planning and treatment, and being able to request or refuse treatment. This right must not be construed as a mechanism to demand the provision of treatment or services deemed medically unnecessary or inappropriate.
Findings include record review, interview:
During an interview with hospital staff #6, and #7 it was confirmed that the patient's parent was not contacted to participate in the patient Treatment Planning process regarding her care.
During record review of the patient's medical record the patients representative was not signed by the representative. The record reflected that it was signed by the minor Patient #11.
During record review the hospital failed to follow its own policy to "At least one initial problem will be identified and discussed with patient/family."
Policy:
The hospital policy Patient Rights dated 10/21/15, reflected, "It is the policy of this hospital to ensure that all patients ...to abide by and respect all patient rights ...shall support and protect the fundamental human, civil, constitutional and statutory rights of the individual patients and recognize and respect personal dignity of the patient at all times."
The hospital Policy for Treatment Planning dated 05/29/17 reflected, "Each patient's care will be guided by a multidisciplinary treatment plan ...The Multidisciplinary Treatment Plan will be initiated by Social Services for all patients admitted to University Behavioral Health of Denton, following completion of the Psychosocial Assessment and the Psychiatric Evaluation within 72 hours of admission. At least one initial problem will be identified and discussed with patient/family ...The treatment plan will have reviewed and/or updated weekly ...Upon discharge the patient will receive a copy of his/her completed treatment plan to provide communication with aftercare providers."
