VIOLATION: PATIENT RIGHTS: FREE FROM ABUSE/HARASSMENT Tag No: A0145
Based on policy review, personnel file review and interview, the hospital staff failed to ensure adequate screening was conducted prior to authorizing employment for 2 of 4 (Employee #1 and 3) employee files review.

The findings included:

1. Review of the hospital policy "Pre-Employment and Continued Employment Requirements" revealed, "Policy:... [name of hospital] will also verify...references...2. [name of hospital] will require the applicant, upon a contingent offer, to complete/sign a Disclosure and Authorization- Disclosure Regarding Background Investigation Form...(Authorizing the National Sex , Abuse Registry..."

2. Review of Employee #1's personnel file revealed a date of hire 2/27/17 for a Certified Nursing Aide position. Employee #1 was terminated on 10/16/17 for violating the hospital abuse policy. There was no evidence the State of Tennessee Abuse Registry was checked prior to authorizing employment. The surveyor was presented with an Abuse Registry check on 10/25/17 at 12:05 PM, that verified Employee #1 was not listed on the registry. The DON stated the Abuse Registry check had been completed by the Human Resources Business Partner on 10/25/17, after the surveyor inquired about the missing document.

3. Review of Employee #3's personnel file revealed a date of hire 5/8/17 for a CNA position. There was no evidence references were verified prior to authorizing employment.

4. During an interview in the Nursing Office on 10/25/17 at 12:15 PM, the Human Resources Business Partner verified there was not a Abuse Registry check for Employee #1 and there were no reference checks for Employee #3.
