PATIENT RIGHTS: INFORMED CONSENT

Based on document review and interview, the F1 staff failed to provide the spouse of a psychiatrically incapacitated patient, information required to make informed decisions about the patient's care of 1 of 10 medical records reviewed. (P10)

Findings Include:

1. P10's medical record (MR) indicated that the patient was admitted on 04/19/2024 on an emergency detention order (EDO). P10's facesheet indicated that C1, Complainant was the emergency contact and spouse of P10. Upon admission, the patient refused to sign treatment consent, or provide a release of information authorization to the facility. On 04/20/2024 a psychiatric evaluation was conducted and P10 was found to be confused, tangential, disorganized, with racing thoughts.

2. At 1459 hours on 05/23/2024, per interview with S5, Milieu Coordinator, confirmed that on 04/21/2024 they did speak with C1, Complainant, regarding their concerns about receiving patient treatment information as the spouse of P10. S5 did not accept the assertion of C1 being the spouse of the patient, requiring additional supporting documentation. and did not provide any patient information to C1.

3. At 1550 hours on 05/23/24, per interview with C1, confirmed that on 04/21/2024 they spoke with S5 identifying themselves as the spouse of P10, and requested information regarding the patient's care. S5 assisted, but did not provide any patient information regarding the hospitalization of P10.
