Based on interview and record review, the facility failed to provide one patient (1) notification of his rights written in a language he understood which had the potential to result in a lack of understanding of his rights and responsibilities as a patient.

Findings:

The clinical record for Patient 1 was reviewed 5/23/12. The history and physical, dated 4/11/12, indicated Patient 1 was Spanish-speaking only. The Conditions of Admission and Authorization of Medical Treatment, dated 4/10/12, was written in English and signed by Patient 1.

During an interview with Registered Nurse A, on 5/23/12 at 11:55 AM, she stated nursing is responsible to review the conditions of admission and patient rights with patients when admissions staff is not available. She stated if a patient speaks Spanish only, then the staff should use the admissions paperwork provided in Spanish.

The facility policy and procedure titled "Language Interpretation", dated 3/08, indicated "[the facility] have an obligation to provide translation of written materials for LEP [Limited English Proficient] patients."
