LICENSURE OF NURSING STAFF

Based on personnel file review, review of the Arkansas Nurse Practice Act, policy and procedure review, and interview, it was determined the Facility failed to ensure the CNO (Chief Nursing Officer) had a valid and current license in the state of Arkansas. The failure to have a Nursing License in Arkansas did not assure that patients were receiving safe, quality care. The failed practice had the potential to affect all patients receiving care in the Facility. Findings follow:
A. Review of Personnel File for the CNO on 09/22/21 at 12:30 PM showed the CNO's nursing license as an Oklahoma Single State License.
B. Review of the Nurse Practice Act of the State of Arkansas, Title 17 Professions, Occupations, and Businesses showed, "It shall be unlawful for any person not licensed by the Board: (1) To practice or offer to practice professional nursing, advanced practice nursing, practical nursing or psychiatric technician nursing;"
C. Review of the policy and procedure titled "Pre-Employment Verification of Professional Qualifications" showed, Policy: "It is the policy of the Company to require verification of all pertinent professional qualifications prior to date of hire. All licenses, certifications, and other required professional documents may need to be provided for Company inspection on or before the first day of employment and must remain current throughout employment. It is the responsibility of Human Resources at each location to assure compliance with this policy." Procedure: "As required by your state, all credentialed professionals are required to furnish proof of licensing, registration or other pertinent certification on or before the first day of employment."
D. In an interview with the CNO on 09/22/21 at 1:00 PM, she confirmed that she did not have a current Arkansas Nursing License and that her license was an Oklahoma single state license.
E. In an interview with the CNO on 09/22/21 at 1:00 PM, she stated that she had been the Interim CNO at the Facility for approximately six weeks and was traveling back and forth from Oklahoma several days each week to fulfil this role.
