Based on observation and interview, the facility failed to post signs specifying the rights of individuals with respect to examination and treatment for emergency medical conditions, and information indicating whether or not the hospital participates in the Medicaid program at the facility entrance, lobby, and four intake rooms where patients were examined. These failures had the potential to affect all patients who presented to the hospital seeking examination or treatment. The facility census was 42.

Findings included:

1. Even though requested, a policy regarding EMTALA signage was not provided.

Observation on 05/01/18 at 9:00 AM, showed no signage pertaining to Patient Rights or Medicaid at the entrance doors to the facility, in the facility lobby, or the four intake patient examination rooms.

During an interview on 05/01/18 at 11:55 AM and continued on 05/03/18 at 9:00 AM, Staff I, Director of Assessment and Referral, stated that the general public still perceives the hospital as having an ED based on how many walk in patients they still get. Regardless whether the hospital had a Dedicated Emergency Department (DED) or not, the hospital would take care of the patients with an unscheduled appointment at all hours.
