PATIENT RIGHTS: NOTICE OF RIGHTS

Based on 1 of 1 record review (Patient #2) the facility could not verify the patient had received a written copy of and an explanation of his patient's rights.

Findings:

1) The facility medical person, who assessed the patient at another acute care facility, and accepted the patient for admission, prepared an admission document #3771, "Statement that you have received patient bill of rights and patient grievance procedure and that it has been explained." The documents included the patient's daughter's name as the support person and the signature of the medical person preparing the forms. The medical person "witnessed" and dated the form. The patient did not sign the form. There was no documentation the patient was unwilling or unable to sign the form.
2) Patient #2 alleged in a complaint, received by the Department, he did not receive a copy of his rights.
3) In an interview with the surveyor at noon on 04/16/12 the CNO (employee #3) confirmed the form should have been signed by the patient. She stated she could not verify the patient received the copy of his rights or an explanation of his rights.

Findings:

1) The facility medical person, who assessed the patient at another acute care facility, and accepted the patient for admission, prepared four admission documents. The documents included the patient's name, his address, his daughter's name and the signature of the medical person preparing the forms. The medical person "witnessed" and dated all of the forms. The patient did not sign any of the forms. There was no documentation the patient was unwilling or unable to sign the forms. The medical record was not accurate.
2) In an interview with the surveyor at noon on 04/16/12 the CNO (employee #3) confirmed the forms should have been signed by the patient. She also confirmed the employee could not witness a signature which was not on the form.
