PATIENT RIGHTS: FREE FROM ABUSE/HARASSMENT

Based on record review and interview, the hospital failed to report an allegation of neglect to Louisiana Department of Health within 24 hours of receipt of the allegation for 1 (#2) of 1 sampled patient reviewed for complaints/grievances alleging neglect or abuse of the patient by hospital staff.
Findings:
Review of the hospital policy titled, "Adult Abuse/Neglect, Alleged or Suspected", Policy Number: A.1.07, revealed in part: Purpose: To provide for the safety of all of our patients with an organized method of inquiry and reporting of suspected abuse including, but not limited to physical assault, rape or other sexual molestation, and domestic abuse or neglect. F. Administrative Review: 1. Upon notification of suspected alleged abuse of the patient, all witnesses will be interviewed individually. 2. The Corporate Risk Manager or designee will notify the Department of Health according to regulations.Definitions: Passive Neglect: The deprivation by a caregiver of goods or services, which are necessary to maintain physical or mental health, without a conscious attempt to inflict physical or emotional distress.
Review of the form utilized by the hospital to report allegations of abuse and neglect to LDH- HSS revealed the following, in part: Hospital Abuse/Neglect Initial Report: Fax completed form within 24 hours of awareness of the allegation to LDH-HSS.
Review of a complaint letter, presented by S2CCO, revealed a family member of Patient #2 had written a letter to a State Senator alleging Patient #2 and other patients dependent upon others for eating were not being fed by staff at the hospital.
In an interview on 10/25/17 at 2:30 p.m. with S2CCO, she explained the previous owner of the hospital had received the above referenced letter from the State Senator. S2CCO reported the previous owner of the hospital and hospital staff had conducted an internal investigation regarding the allegations referenced in the letter. S2CCO confirmed the hospital had not self- reported the allegation of neglect to LDH- HSS within 24 hours of awareness of the allegation.
