PATIENT RIGHTS: NOTICE OF RIGHTS

Based on record review and interview the facility failed to ensure patients or the patient's representative was informed of the patient's rights, in advance of furnishing or discontinuing patient care in 7 of 12 (P - 2, 3, 4, 5, 6, 7, 12) medical records reviewed. Resulting in the potential for the loss of patient rights for the 8 patients currently at the facility. Findings include:

On 8/7/2023 at approximately 1200, during record review with Staff D and Staff E, seven medical records (P - 2, 3, 4, 5, 6, 7, 12) revealed no evidence that patients received information on patient rights and responsibilities in accordance to the facility's Rights and Responsibilities policy.

On 8/7/2023 at 1300 guardian of patient P-2 was interviewed at the bedside. When queried if she received any education on patient rights and responsibilities, she responded "no".

On 8/8/2023 at 1200 an interview with Quality RN Staff H was conducted and she stated in the past they handed out a pamphlet, but they no longer do, and that patient rights information is given verbally to the patient's or patient's representative and documented on the patient and family education record. On 8/8/23 medical records (#2, 3, 4, 5) were re-reviewed with the assistance of Staff H, and confirmed no documentation that education on patient rights had been provided to the patient or patient's representative. Staff H was queried on education documentation and stated Patient Rights education should have been documented on the Patient and Family Education record for all the patients.

Policy titled, "Rights and Responsibilities", dated last revised 7/2023 states under procedure bullet 2 and 3, "Patient Rights and Responsibilities will be given in advance of furnishing or discontinuing patient care ...., Rights and Responsibilities Language section lists items to be given, to include but not limited to, "Not be denied appropriate care on basis of age, race, ethnicity, religion... you are entitled to inspect...medical record...confidential treatment... privacy... refuse treatment... you may present grievance... be free of abuse and neglect.
